Terms and Conditions

1. Acceptance of Terms
By using the application (the "App"), you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you must not use the App.
2. Service Description
The App is designed to manage and centralize the complete educational journey of persons deprived of liberty. We provide tools and resources to facilitate tracking and improving educational progress, promoting digital inclusion and education in line with the right to education recognized by the Argentine Constitution and the American Convention on Human Rights (Pact of San José).
3. Use of the App
Eligibility: You must be an authorized individual to use the App.
User Responsibility: You are responsible for your use of the App and for any content you upload, share, or store, acting in good faith and in compliance with applicable law.
Prohibited Uses: You must not use the App for unlawful activities, infringe others’ rights, violate third-party privacy, or upload offensive, defamatory, or discriminatory content.
4. Intellectual Property
All intellectual property rights related to the App and its content (excluding user content) are owned by The Metadata Company LLC or its licensors. You may not copy, modify, distribute, sell, or lease any part of the App without our permission.
5. Privacy
Your privacy matters to us. Please review our Privacy Policy for details on how we collect, use, and protect your personal information under the EU GDPR (Regulation (EU) 2016/679), Argentina’s Law No. 25,326, and the OECD Privacy Guidelines.
6. Limitation of Liability
The App is provided "as is" and "as available". We do not warrant that the App will be error-free, secure, or uninterrupted. To the extent permitted by law, The Metadata Company LLC shall not be liable for any direct, indirect, incidental, or consequential damages arising from the use or inability to use the App.
7. Changes to the Terms
We may update these Terms and Conditions from time to time. We will notify you by posting the updated terms in this section. You are responsible for reviewing these terms periodically.
8. Termination
We may suspend or terminate your access to the App at any time and for any reason, including breach of these Terms and Conditions or as required by law.
9. Governing Law and Jurisdiction
These Terms and Conditions are governed and construed under the laws of the State of New Mexico, United States of America, with The Metadata Company LLC as the owner and operator of the “alfabetiz.ar” service.

Because the App is primarily offered and used within the Argentine Republic, the processing of users’ personal data complies with Argentina’s Personal Data Protection Law No. 25,326, Law No. 26,032 on Internet services, and complementary regulations issued by the Access to Public Information Agency (AAIP).

The App also observes the principles of the EU General Data Protection Regulation (GDPR – Regulation (EU) 2016/679) and the OECD Privacy Guidelines for transborder data flows.

Where applicable, CCPA/CPRA (California), UK GDPR (United Kingdom), and LGPD (Brazil) rights and obligations shall also apply, as outlined in the Privacy Policy’s jurisdiction-specific addendum.

Accordingly, any dispute arising from the interpretation or performance of these Terms shall be submitted exclusively to the competent courts of the State of New Mexico, USA, without prejudice to the supplementary application of Argentine law on data protection and other mandatory public-order rules where applicable.
